Regulations of the online store Modellers World

1. DEFINITIONS

  • Working days – days from Monday to Friday, excluding public holidays.
  • Account – a free feature of the store (service provided electronically) that allows the Buyer to create an individual account in the store, governed by separate regulations.
  • Consumer – a natural person making purchases in the store, as defined in the Civil Code.
  • Buyer – any entity making purchases in the store.
  • Regulations – these rules and regulations.
  • Store – Modellers World online store, operated by the Seller at https://www.modellersworld.eu.
  • Seller – Michał Wiśniewski, conducting business under the name of Modellers World Michał Wiśniewski, registered in the Central Register of Business Activity and Information (NIP: 5581772929, REGON: 369946493), with headquarters at 5 Dorodna Street, 85-790 Bydgoszcz.

3. TECHNICAL REQUIREMENTS

In order to use the store and service, the following are necessary:

  • A device with access to the Internet.
  • A web browser that supports JavaScript and cookies. To view images, a browser that supports the WebP format is required.
  • For placing an order in the store, an active e-mail account is required.

4. ACCOUNT.

  • Creating an account in the store is voluntary and depends solely on the will of the Buyer.
  • An account allows the Buyer to have additional functions, such as viewing order history, checking order status and editing personal information on their own.
  • To set up an account, the Buyer must fill out the appropriate form on the store’s website.
  • Upon creation of an account, a contract is concluded between the Buyer and the Seller for an indefinite period of time, which includes the maintenance of the account in accordance with the provisions of the regulations.
  • The buyer may cancel the account at any time without any cost. To cancel, send a request to the e-mail address: [email protected]. The account will be immediately deleted, and the contract for the operation of the account will be terminated.
  • Complaints about the operation of the account can be submitted to the e-mail address: [email protected]. The seller will consider the complaint within 14 days of receiving the request.

5. SHOPPING IN THE STORE

  • Prices of goods in the store are final prices, the Seller is exempt from VAT.
  • Sales are made in several currencies, and the default currency is EURO. The customer has the option to change the currency and make a purchase in his preferred currency. Prices in other currencies are converted based on the current exchange rate.
  • The total price of the order includes the price of the goods and, if applicable, the delivery costs indicated in the store.
  • To make a purchase, you need to add the selected products to the shopping cart, select the delivery method and payment method, and provide the data necessary to complete the order.
  • Placing an order follows its confirmation and acceptance of the regulations by the buyer, which is equivalent to the conclusion of a sales contract.
  • The Seller will confirm the conclusion of the contract of sale electronically (e-mail), at the latest when the payment is registered or the goods are shipped – whichever comes first.
  • The buyer can make purchases without registration, each time providing the necessary data when placing an order.

6. PAYMENTS

  • Buyer can pay for the order by:
    • Transfer to the Seller’s bank account.
    • Payment platforms such as Stripe, PayPal and debit card payments, BLIK, etc.
    • Payment by cash on delivery, i.e. at the courier’s office upon receipt of the goods (applies to orders within Poland).
  • In the case of payment by bank transfer, the order must be paid within 3 working days of its placement. After this date, the order will be canceled.
  • Some payment methods (e.g. PayPal) require payment of the order immediately after placing it.
  • The Buyer accepts the use of electronic invoices by the Seller, with the option to withdraw this acceptance.
  • Non-VAT invoices are issued upon the customer’s request, which can be made in the comments to the order or by email after the order is placed.

7. SHIPPING COSTS AND DELIVERY METHODS

  • The buyer can choose one of the available shipping methods, which will appear after adding products to the shopping cart and selecting the destination country. The country of delivery can be selected on the shopping cart or order page.
  • The cost of shipping by mail depends on the weight of the order and is automatically updated on the shopping cart and order page.
  • The cost of shipping via DPD is fixed and does not depend on the weight of the order. It is visible when you select the country of delivery, as long as DPD offers service in your area.
  • Within the European Union it is possible to order to DPD partner points and parcel machines.
  • In Poland, we offer parcel services from InPost, Pocztex, DPD and the Polish Post Office.
  • Delivery methods depend on the country of delivery, and the binding shipping cost is shown in the order form.
  • In case of problems with the shipment, resulting from the side of the courier company, we offer customer assistance and support. In this case, please contact us at e-mail: [email protected] or through the Customer Support form on the store website.

8. ORDER FULFILLMENT

  • The seller undertakes to deliver the goods without defects.
  • Order processing time is from 1 to 3 working days for in-stock products and up to 10 working days for “custom” products.
  • If the Buyer has chosen to pay in advance, order processing will begin after the payment is credited.
  • If products with different lead times are ordered, the entire order will be shipped according to the longest lead time.
  • Goods are delivered via courier, mail, parcel machines or partner points – depending on the delivery method selected by the Buyer.

9. RIGHT TO WITHDRAW FROM THE CONTRACT

  • The consumer has the right to withdraw from the contract concluded with the Seller within 30 days without giving any reason, subject to the exceptions provided for in §10 of the Regulations.
  • The deadline for withdrawal expires 30 days after the day on which the Consumer took possession of the goods, or on which a third party designated by the Consumer, other than the carrier, took possession of the goods.
  • In order to exercise the right of withdrawal, the Consumer must inform the Seller of his/her decision using the contact information provided in §2 of the Terms and Conditions (e.g. by e-mail or letter sent by mail).
  • The Consumer may use the model withdrawal form, but it is not mandatory.
  • In order to meet the deadline for withdrawal, it is sufficient for the Consumer to send information about exercising the right of withdrawal before the expiry of 30 days.

Effects of withdrawal:

  • In the event of withdrawal from the contract, the Seller will refund to the Consumer all payments received, including delivery costs (except for additional costs resulting from choosing a delivery method other than the cheapest available), no later than 14 days after receipt of the withdrawal information.
  • Refund of payments will be made by the same methods used by the Consumer in the original transaction, unless the parties agree otherwise. The Consumer will not bear any costs associated with the return of the payment.
  • The Seller may withhold reimbursement until it receives the returned goods or proof of their return, whichever comes first.
  • The goods should be sent back to the address: 5a Dorodna Street, 85-790 Bydgoszcz, no later than 14 days from the date of withdrawal from the contract. The deadline will be met if the Consumer sends back the goods before the expiration of 14 days.
  • The Consumer shall bear the cost of returning the goods.
  • The consumer is liable only for the diminution in the value of the goods resulting from the use of the goods beyond what is necessary to ascertain their nature, characteristics and functioning.

10. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal from a contract concluded at a distance does not apply to the Consumer for contracts:

  • For the supply of goods manufactured to the Consumer’s specifications or serving his individual needs.
  • For the delivery of goods that are perishable or have a short shelf life.
  • For the delivery of goods in sealed packages that, once opened, cannot be returned for health or hygiene reasons.
  • For the delivery of things that after delivery, due to their nature, become inseparable from other things.
  • For the delivery of sound recordings, visual recordings or computer programs delivered in a sealed package that has been opened after delivery.
  • For the delivery of newspapers, periodicals or magazines, except for a subscription or newsletter contract.
  • For the delivery of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the Consumer before the expiration of the deadline for withdrawal from the contract.

11 COMPLAINTS

  • In the event of a defect in the goods, the Buyer has the right to complain about the defective product on the basis of the warranty (regulated in the Civil Code) or guarantee, if any was granted.
  • Using the warranty, the Buyer may, in accordance with the provisions of the Civil Code:
  • Submit a statement of price reduction.
  • With a material defect – withdraw from the contract.
  • Demand a replacement of the goods with a new one, free of defects.
  • Demand removal of the defect.
  • Complaints on the basis of warranty should be submitted to the postal or electronic address specified in §2 of the Regulations.
  • If it is necessary to deliver the defective goods in order to consider the complaint, the Buyer (Consumer) is obliged to send it back at the expense of the Seller to the address: 5a Dorodna Street, 85-790 Bydgoszcz.
  • If the goods are covered by a warranty, information about its terms and conditions can be found in the description of the product in the Store.
  • Complaints about the operation of the Store should be reported to the e-mail address specified in §2 of the Regulations. The Seller will consider the complaint within 14 days of its receipt.

12. PERSONAL DATA

  • The administrator of the Buyer’s personal data is Michał Wisniewski, conducting business under the name Modelarski Świat Michał Wisniewski, 5 Dorodna Street, 85-790 Bydgoszcz, NIP: 5581772929, REGON: 369946493.
  • Personal data is processed on the basis of the contract for the purpose of order completion and on the basis of consent for marketing purposes (e.g. Newsletter subscription).
  • The buyer has the right to access his personal data, rectify, delete, limit processing, transfer data and object to the processing of data for marketing purposes.
  • The buyer may withdraw consent to data processing at any time by contacting by email: [email protected] or through contact forms available in the store.
  • Personal data is kept for the time necessary for the execution of the contract and in accordance with the law. Data of an inactive customer will be deleted after 5 years. Data processed on the basis of consent is stored until it is withdrawn.

  • The buyer has the right to file a complaint with the data protection supervisory authority.

13. DISCLAIMERS

  • It is forbidden for the Buyer to provide unlawful content.
  • Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the terms and conditions. The contract is concluded for the duration of the order.
  • Contracts concluded on the basis of these regulations are drawn up in the Polish language.
  • None of the provisions of these Regulations does not exclude or limit the rights of the Consumer under the law.

14. PROVISIONS FOR BUYERS WHO ARE NOT CONSUMERS

  • The right of withdrawal from a contract concluded remotely does not apply to non-Consumers.
  • Seller’s liability to Buyers who are not Consumers is limited to the amount of the order.
  • The Seller’s liability under warranty to Buyers who are not Consumers is limited to one year from the date of issue of the goods.
  • In case of a dispute with a Buyer who is not a Consumer, the competent court shall be the court appropriate to the Seller’s registered office.

15. REGULATIONS OF THE “FREE DELIVERY” OPTION

  • The “Free Delivery” promotion applies to selected countries of the European Union for orders with a value of more than 150 EUR or the equivalent in another currency.
  • If free shipping is available in the country of delivery, this option will automatically appear on the order processing page.
  • To take advantage of the promotion, you must select the free shipping option when placing your order. We do not refund shipping costs if the Buyer chooses another delivery method.

NEWSLETTER TERMS AND CONDITIONS
of Modellers World online store

1. DEFINITIONS

  • Newsletter – a free electronic service that allows the Subscriber to receive e-mails from the Service Provider regarding the Store, including information about offers, promotions and news.
  • Store – an online store operated by the Service Provider at: https://www.modellersworld.eu.
  • Service Provider – Michał Wiśniewski, conducting business under the name Modelarski Świat Michał Wiśniewski, with registered office at 5 Dorodna Street, 85-790 Bydgoszcz, NIP: 5581772929, REGON: 369946493.
  • Subscriber – the person using the Newsletter service.

2. NEWSLETTER

  • Newsletter subscription is voluntary.
  • In order to use the Newsletter service, an active e-mail account, a web browser that supports JavaScript and cookies, and Internet access are required.
  • Newsletters will be sent to the e-mail address provided by the Subscriber when signing up for the service.
  • To sign up for the Newsletter, the Subscriber enters his/her e-mail address in the designated field on the Store’s website. The Service Provider will send an e-mail with a verification link. After confirming the subscription, the Newsletter service agreement is concluded.
  • The Service Provider may use the Newsletter to conduct marketing campaigns and inform about news and updates related to the Store, including YouTube and Patreon content.
  • The subscriber may unsubscribe from the Newsletter at any time by sending an e-mail to: [email protected]. Unsubscribing from the Newsletter results in immediate termination of the contract.

3. COMPLAINTS

  • Complaints regarding the operation of the Newsletter service should be submitted to the e-mail address: [email protected].
  • The Service Provider will consider the complaint within 14 days of its receipt.

4. PERSONAL DATA

  • The administrator of the Subscribers’ personal data is the Service Provider.
  • Personal data is processed for the purpose of providing the service in accordance with the provisions of RODO. Details on the processing of personal data can be found in the privacy policy available in the Store.
  • The Subscriber has the right to access his/her data, correct it, delete it, limit its processing and object to its processing for marketing purposes.
  • The Subscriber may request the deletion of his/her personal data at any time by contacting by email, telephone or through a form in the Store.
  • Personal data is protected by using appropriate encryption protocols.

5. FINAL PROVISIONS

  • The Service Provider reserves the right to change the Terms and Conditions for important reasons, such as modernization of the service or changes in legislation.
  • Subscribers will be informed of planned changes at least 7 days before they take effect.
  • If the Subscriber does not object to the changes, he/she is deemed to accept them. In case of non-acceptance, the Subscriber may terminate the contract by sending an appropriate message to the Service Provider’s e-mail address.
  • The Subscriber is prohibited from providing unlawful content.
